The DeVito Team of Keller Williams Realty Greater Nassau, including Joseph DeVito (collectively, “The DeVito Team,” “we,” “us,” or “our”), wants you to be familiar with how we collect, use, and disclose information. This Privacy Policy describes our practices in connection with information we collect about you as an individual consumer (“you”) through our website at thedevitoteam.com and any related web-based tools, search features, accounts, valuation tools, online contact forms, and email or offline interactions we have with you (collectively, the “Services”). All references to “including” in this Privacy Policy mean “including without limitation.” This Policy should be read together with our Terms of Use.
We are an independent real estate team affiliated with Keller Williams Realty Greater Nassau, a Keller Williams® Market Center. Keller Williams Realty, LLC is a real estate franchisor; its own privacy practices for the platforms it operates are described at legal.kw.com and apply to the extent your information is provided to Keller Williams Realty, LLC. This Policy governs information collected through our Services.
Section 1: Personal Information
“Personal Information” is information that identifies you as an individual or relates to an identifiable individual. We may collect the following categories of Personal Information from you via the Services when you choose to share it:
- Identifiers, such as your real name, postal address, Internet Protocol (“IP”) address, email address, telephone number, and account name;
- Commercial information, such as your real estate buying or selling interests and preferences, and the properties and searches you save;
- Financial information, such as information about a property’s value, taxes, or your financing, when you choose to share it with us;
- Geolocation data, which may be derived from your IP address or mobile device;
- Account information, including log-in information for third-party services such as Google or Facebook, if you choose to link those accounts; and
- Other Information (as defined in Section 2), to the extent we are required to treat it as Personal Information under applicable law.
Collection of Personal Information
We and our service providers collect Personal Information in a variety of ways, including:
- Directly from you — for example, when you fill out a contact or valuation form, register an account, request a market analysis of your home, or contact us by phone or email;
- Automatically when you use the Services — through cookies, pixel tags, and similar technologies, as described in Section 2; and
- From other sources — including Keller Williams® Market Centers or their agents who share information you provided to them, publicly available databases, the MLS, and marketing partners or vendors.
We collect Personal Information to provide the Services you request, to improve our existing Services, and to develop new ones. If you do not provide the information we request, we may not be able to provide you with the Services you requested.
Use of Personal Information
We and our service providers use Personal Information to:
- provide the functionality of the Services and fulfill your requests — including arranging access to your registered account, providing user support, and responding to your inquiries;
- verify your email address before releasing sold/closed listing data, as required by the MLS;
- send you administrative information, such as changes to our terms and policies;
- send you marketing communications and property updates you have requested or consented to receive, and facilitate any social-sharing features you choose to use;
- analyze use of the Services to understand preferences, prepare aggregated trend reports, and personalize the content and offers we provide; and
- accomplish our legitimate business purposes — including data analysis, audits, fraud and security monitoring, developing and improving Services, and operating our business.
Disclosure of Personal Information
We may disclose Personal Information:
- to our service providers and business partners who perform functions on our behalf (for example, hosting, email delivery, payment processing, analytics, and IT and related infrastructure), under obligations of confidentiality;
- to Keller Williams Realty Greater Nassau and its agents, and to Keller Williams Realty, LLC and its regional representatives, where you have requested such sharing, inquired about a property, or where we have a legitimate business interest;
- to third parties you direct us to share with, or content you voluntarily post in any public area of the Services (which may become public); and
- as necessary to comply with applicable law, cooperate with public authorities or law enforcement, enforce our terms, protect our rights, safety, or property, or in connection with a sale or business transaction.
As of the “Last updated” date above, we do not “sell” your Personal Information (as that term is defined under applicable law).
Section 2: Other Information
“Other Information” is any information that does not reveal your specific identity, such as browser and device information, usage data, demographic information, information collected through cookies and similar technologies, and aggregated information. We and our service providers may collect Other Information:
- Through your browser or device — such as your IP address, device type, operating system, browser type, language, and the actions you take on the Services, to help us ensure the Services function properly and to improve them;
- Using cookies — small files stored on your device that let us recognize you, remember your preferences, keep you signed in, facilitate navigation, improve and personalize the Services, and gather statistical usage information. Most browsers let you decline cookies or be notified when one is set; if you decline cookies, some features (such as staying logged in) may not work. To learn about opting out of interest-based advertising, visit the Network Advertising Initiative at networkadvertising.org. We do not currently respond to browser do-not-track signals;
- Using pixel tags and similar technologies — to track actions of users (including email recipients), measure the success of marketing campaigns, and compile usage statistics; and
- Through analytics services, including Google Analytics — which use cookies to collect and analyze information about use of the Services. You can learn about Google’s practices at policies.google.com/technologies/partner-sites and opt out via the Google Analytics opt-out add-on.
We may use and disclose Other Information for any purpose, except where we are required to treat it as Personal Information under applicable law. If we combine Other Information with Personal Information, we will treat the combined information as Personal Information for as long as it is combined.
Section 3: Security
We seek to use reasonable organizational, technical, and administrative measures to protect Personal Information, including storing account passwords in hashed form. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you believe your interaction with us is no longer secure, please notify us using the “Contacting Us” section below.
Section 4: Choices and Access; Privacy Rights
Opting out of marketing communications
You may opt out of receiving marketing-related emails from us by using the unsubscribe link in the message or by emailing joseph@thedevitoteam.com with your request. Please note you cannot opt out of transactional or administrative messages related to your account or a transaction.
Accessing, correcting, or deleting your Personal Information
Depending on your state of residence, applicable law may give you rights regarding the Personal Information we hold about you, including the right to request access to it, to request that we correct or delete it, to request a copy in a portable format, and to opt out of certain uses. We will not discriminate against you for exercising these rights. To make a request, email joseph@thedevitoteam.com and clearly state the nature of your request; we may need to verify your identity before responding. We endeavor to respond within the time required by applicable law. If you provided your Personal Information directly to a Keller Williams® Market Center or another agent, please submit your request to them directly.
Section 5: Phone Calls and Text Messages
If you are a United States resident using the Services, you represent and warrant that:
- you are at least 18 years old;
- you live in the United States;
- you are the account holder for the telephone numbers you provide, or you have authorization from the account holder to provide consent; and
- the telephone numbers you provide are accurate, and you will let us know if you release them to a third party.
Do Not Call Policy. This is our Do Not Call Policy under the Telephone Consumer Protection Act. Unless applicable law allows or you provide consent, we do not solicit telephone numbers listed on the National Do Not Call Registry or a state Do Not Call list. If you communicate with us by telephone, we may monitor or record the call in accordance with applicable law.
Text messaging. We do not share or sell mobile phone numbers or text-message opt-in consent with third parties or affiliates for their marketing or promotional purposes. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.
Opting out. You may revoke your consent to receive calls and texts at any time by emailing joseph@thedevitoteam.com, or reply STOP to a text message to stop texts. Please allow up to 30 days to process your request. If a Keller Williams® Market Center or another agent separately has your number, you must contact them directly to opt out of their communications.
Section 6: Retention Period
We retain Personal Information for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the information; the length of our relationship with you (for example, while you maintain an account); the potential risk of harm from unauthorized use or disclosure; the purposes for which we process the information; and applicable legal, MLS, and recordkeeping requirements.
Section 7: Third-Party Services
This Privacy Policy does not address, and we are not responsible for, the privacy or other practices of any third parties, including Keller Williams® Market Centers, their agents, OneKey® MLS, or any third party operating a website or service to which the Services link, or providers such as Google, Apple, or Meta. The inclusion of a link or feature does not imply our endorsement. Your use of mapping features (such as Google Maps) is subject to the applicable third-party terms and privacy policies.
Our Services may display third-party advertisements. If you choose to interact with or submit your information to an advertiser, that information is provided by you directly to the advertiser and is governed by the advertiser’s own privacy practices, not this Policy. We do not sell your Personal Information.
Section 8: Use of Services by Minors
The Services are not directed to, or intended for use by, individuals under the age of 16, and we do not knowingly collect Personal Information from individuals under 16. Please email joseph@thedevitoteam.com if you believe we have collected information from an individual under 16.
Section 9: Jurisdiction and Data Storage
We operate in the United States. Your Personal Information may be stored and processed in the United States, where our service providers’ facilities may be located, which may have data-protection rules different from those of your jurisdiction. By using the Services, you consent to the storage and processing of your information in the United States. The Services are intended for users in the United States and are not directed to individuals in any jurisdiction where such use would be contrary to law.
Section 10: Sensitive Information
Unless we request it, we ask that you not send us, or otherwise disclose to us through the Services, any sensitive Personal Information, including Social Security numbers, full payment-card or bank-account numbers, or information about racial or ethnic origin, political opinions, religion, health, biometric or genetic characteristics, or criminal background.
Section 10A: MLS / IDX Listing Data (OneKey® MLS)
Property listing information on the Services is provided through the IDX and/or VOW programs of OneKey® MLS and is deemed reliable but not guaranteed. To access certain MLS data — such as sold/closed prices — you must register a verified account, as required by the MLS’s rules. We may retain your registration information as needed to demonstrate compliance with those rules. Your use of MLS listing data is also governed by our Terms of Use.
Section 11: Updates to This Privacy Policy
The “Last updated” legend at the top of this Privacy Policy indicates when it was last revised. Any changes become effective when we post the revised Policy on the Services. Your continued use of the Services following any changes means you accept the revised Policy. If you do not agree, your choice is to discontinue use of the Services.
Section 12: Contacting Us
The DeVito Team of Keller Williams Realty Greater Nassau, located at the address below, is responsible for the collection, use, and disclosure of your Personal Information under this Privacy Policy. If you provided your Personal Information directly to another Keller Williams® Market Center or agent, please contact them directly regarding their practices. Because email is not always secure, please do not include sensitive Personal Information (such as a Social Security, bank-account, or credit-card number) in emails to us.
